OK. So I am planning to go to the apple store to get some help with my touch. (Its doin somethin weird)

I jailbroke it, but i restored it as a new ipod.

BUT. it still has the new FIMRWARE 3.0 i believe it was, but i DIDNT pay for it. My friend put it in for me.

Now can apple tell that i didnt pay for the newest version? should i download the version it came with?

Sucks for you. If you bought it with your account legitly, Thats fine

If you jailbreak and get 3.0, Even if you restore they need your iTunes account email to see if you paid for it or not.

See, This is why you bitches get owned stealing from Apple. I keep my iTouch legit, You jailbreak yours and cry over breaking it whereas i can get a new one and get all my stuff recovered.

Oh, And ALL purchases go through your apple account so it doesnt matter if you decide to restore it, They'll know.

Cant afford to jailbreak mine, I have a black tie warranty from Best Buy. Shit covers everything.
